DWI/DUI Season is here…so How Long Does Alcohol Stay In Your System? …And DUI/DWI Checkpoint Info

DWI/DUI Season is here…so How Long Does Alcohol Stay In Your System?
The short answer is one hour per one ounce of alcohol consumed. NOTE: the following information is an estimate, not an absolute rule or precise science.
The liver processes one ounce of pure alcohol in sixty minutes, on average, and a standard drink contains 0.6 ounces of alcohol. Standard drinks include 12 oz. of beer, 8 oz. of malt liquor, 5 oz. of wine, or 1.5 oz. of liquor. Also, the more you drink, the longer alcohol stays in your system. So a DWI/DUI is more likely if you drink many drinks in a row and get behind the wheel. For example, if you drink one beer at 5:00, your system will be clear by 6:00. If you drink one beer at 5:00 and then another at 5:30, your system will not be clear until 7:00. So drunk driving may occur if you do not space out you drinks or best bet is to not drink at all if you are the driver. See Blood Alcohol Content (BAC) Chart: https://www.moderation.org/bac/bac-men.html#

The police are out and pulling people over for drunk driving. Some counties allow roadblocks/checkpoints during holiday times or other seasonal reasons as determined by the county you are in. And, DWI checkpoints are legal simply because the U.S. Supreme Court allows police agencies to operate them. Therefore, as a rule if you are drinking – it is always best to get a ride from someone else like a family/friend/Taxi/Uber driver.

DWI checkpoints have raised constitutional questions for years.  The United States Supreme Court, as well as New York courts, has held that checkpoints are permitted.  However, police must follow certain requirements when establishing these checkpoints so that the impact on drivers’ constitutional rights is as minimal as possible.  Protecting a driver’s rights during a checkpoint and any subsequent arrest and criminal case is extremely important, and is required by the Federal and New York State Constitutions.  The best way to ensure your rights are protected in this way is to hire an experienced DWI attorney who understands the law.
