It looks like we have survived another trying year. I wish all a Happy and Healthy Holiday.

Now for the grim reality. Do not ignore any notifications you may receive from either the court system or other attorneys. Things might have slowed down in your life but I can assure you that criminal warrants are being issued and civil defaults are being entered. The holiday season also presents other potential problems. Do not fall for the misconception that police have slowed down in patrolling for DWI and DUI. They have not. If anything they have stepped up enforcement.

If you are currently on probation expect a visit by the probation department. If you’ve been ordered to drive with an interlock device make sure you have one installed in the vehicle you are driving. There is a steady flow into court of persons, previously convicted, cited for violations of probation which can have severe consequences, including incarceration.

If you are detained and/or arrested you have the absolute right to consult an attorney. If you have been told that consulting an attorney can only make things worse you’ve been misadvised. If you can potentially be charged with a misdemeanor or a felony or even a violation you are better off consulting with an attorney. You have a right to remain silent. No negative inference can be made against you if you excercise a constitutional right. No matter is too small.

A DWI/DUI can have disastrous consequences on your life. These include, but are not limited to, loss of driving privileges, incarceration, a criminal record, probation, loss of employment, loss of future employment opportunity etc.  Similarly, a drug charge stemming from marijuanna, cocaine, meth, heroin, fentanyl etc. can wreak havoc upon your life, aside from the fact that many of these drugs can kill you.  The courts are being inundated with drug cases. If you have a problem please get help. Aside from the severe criminal consequences, many of these drugs are adulterated. Fetanyl is flooding the market. You can die!
